While incarceration may be proper for young person of very serious crimes such as murder, this paper argues that a teen should not be waived into adult criminal courts; sentence of life without the possibility of parole, an adult sentence, is not appropriate for younker offenders; racial disparities within this system must be examined; and to a greater extent safeguards must be put in place to swear out in the rehabilitation of these populations.
